Staff Analysis of the Legislation

This legislation requires law enforcement agencies to copyright or watermark a photograph of an individual who is arrested or taken into custody before placing the photograph on the website or making it available to the public. 
 
Further, is amends the open records law to allow the county to obtain and enforce trademark and copyright protection for the photographs and any other public records.
 
Finally, it establishes commercial use of certain individual's persona without their permission as a tort (i.e., a wrongful act for which damages may be awarded).
